Privacy Policy
Last updated 6 September 2026
This policy explains what happens to personal information on the Smaks Enterprise corporate website. It is written with the Protection of Personal Information Act (POPIA) in mind. The short version: this website collects nothing about you, sets no cookies, and runs no analytics.
1.Who we are
This website is published by Smaks Enterprise (Pty) Ltd, registration number 2024/634827/07, a company registered in South Africa.
For the purposes of POPIA we are the responsible party for any personal information described in this policy. You can reach us at info@smaksenterprise.co.za.
Our Information Officer is Richard Semakaleng Ndweni, who can be reached at Richard@smaksenterprise.co.za.
2.What this policy covers — and what it does not
This policy covers this website only — the corporate site at smaksenterprise.co.za.
It does not cover our four products. Aqilo, Oriva, Alogi and Tomara are separate applications, on separate domains, with their own accounts and their own databases. They collect different information for different reasons, and each has its own privacy policy on its own site:
- Aqilo — aqilo.tech
- Oriva — oriva.tech
- Alogi — alogi.tech
- Tomara — tomara.tech
If you are a parent, learner or student using one of those products, the policy that applies to you is the one on that product’s site, not this one.
3.What this website collects
Nothing, unless you write to us. This site has no accounts, no sign-up, no forms and no input fields of any kind. There is nothing here to submit.
The only way to send us personal information through this site is to use the email address above, which opens your own email program. If you do write to us, we receive whatever you choose to put in that email — typically your name, your email address, and whatever your enquiry is about.
4.Cookies and similar technologies
This website sets no cookies. It does not use localStorage, sessionStorage, tracking pixels, fingerprinting or any similar technology. That is why you are not being asked to accept anything.
5.Analytics and third parties
We run no analytics on this site. There is no Google Analytics, no tag manager, no advertising pixel and no third-party script of any kind.
Every file this page loads comes from this website itself, including the typefaces — they are served from our own domain rather than fetched from a font service, so no third party is contacted when you read this page.
Links to Aqilo, Oriva, Alogi and Tomara are ordinary links. We do not pass any information about you to those sites; following one is the same as typing the address yourself, and what happens after that is governed by that site’s own policy.
6.Website hosting and server logs
Like almost any website, the server that delivers these pages may keep technical access records — typically an IP address, the page requested, a timestamp and a browser identifier. These are generated by the hosting infrastructure rather than collected by us, and we do not use them to build a profile of you.
This website is hosted by Vercel Inc. On our plan Vercel makes these records available to us for one day, after which we can no longer retrieve them. We run no log drain and no external logging, monitoring or error-tracking service, so no copy is sent anywhere else, and we keep no copy of our own.
How long Vercel itself keeps the underlying records is a separate question with a different answer. Vercel treats this kind of service-generated data as its own rather than ours, and publishes no fixed period for it — only that it retains information for the minimum period necessary.
7.Why we process information, and on what basis
There is one purpose: to read and reply to enquiries sent to the address above. If you write to us about a partnership, a press question or one of our products, we use your message and your contact details to respond to you.
We do not sell personal information, we do not share it for marketing, and we do not use it for advertising or profiling.
8.How long we keep it
We keep enquiry emails until your enquiry is resolved, and after that only for as long as is reasonably necessary for legitimate business or legal purposes. You can ask us to delete your enquiry sooner — see your rights below.
9.Security
We take reasonable steps to protect information sent to us, and we keep what we hold to a minimum — which is the most effective protection available, because information that was never collected cannot be exposed.
We are not going to tell you that any system is completely secure. No one can honestly say that. If a breach were to affect your personal information, POPIA requires us to notify you and the Information Regulator, and we would.
10.Your rights under POPIA
In relation to personal information we hold about you, you may:
- ask what we hold, and get a copy of it
- ask us to correct it if it is wrong or incomplete
- ask us to delete it
- object to us processing it
- complain to the Information Regulator
To exercise any of these, write to info@smaksenterprise.co.za. In practice, for this website, what we hold is your email if you have sent us one.
The Information Regulator of South Africa is the body that oversees POPIA, and you can complain to them directly. Their current contact details are published on their own website.
11.Children
This is a corporate website aimed at adults — people looking into who we are, what we build, or how to reach us. It is not directed at children, and it collects nothing from anyone, including children.
Some of our products are used by learners and students. Where a child’s information is involved, that is handled by the product concerned and governed by that product’s own privacy policy and consent process — not by this page.
12.Information sent outside South Africa
Yes, some of it does. Our hosting provider, Vercel Inc., is based in the United States, and this website is deployed in its iad1 region — Washington, D.C., United States. Pages themselves are delivered from whichever of Vercel’s edge locations is nearest you, which for most South African visitors is Cape Town, but the technical access records described in section 6 are handled by infrastructure outside South Africa.
POPIA permits transfers of this kind on specific bases. The safeguard in place here is contractual: Vercel’s data processing addendum binds it on how this information is handled, and incorporates the European Commission’s 2021 standard contractual clauses, which also govern onward transfers to anyone it works with in turn.
13.Changes to this policy
If this policy changes we will update the date at the top of this page. Because the site collects so little, we do not expect it to change often.
14.Contact us
For anything in this policy, or to exercise any of the rights above, write to info@smaksenterprise.co.za.
